Limitation of Warranty and Liability

L. Brügge­mann GmbH & Co. KG, Brugge­man­nChem­ical U.S., Inc., Bruegge­man­nChem­ical Asia Ltd. as well as their affil­i­ated companies (here­in­after collect­ively referred to as the “Brügge­mann Group”) provide no guar­an­tees or warranty and provide no declar­a­tions of condi­tion concerning the suit­ab­ility of the products of the Brügge­mann Group (here­in­after “Brügge­mann products”) for resale or concerning the suit­ab­ility of Brügge­mann’s products for specific types of use or other intended purposes.

Moreover the companies of the Brügge­mann Group give no guar­an­tees or warranties and make no declar­a­tions of condi­tion concerning the chem­ical or phys­ical prop­er­ties of Brügge­mann products described herein, neither expressly nor implied, nor in any oral or written inform­a­tion of the companies of the Brügge­mann Group.

The inform­a­tion contained herein and any other related inform­a­tion provided orally or in writing by companies of the Brügge­mann Group reflects the current know­ledge of the Brügge­mann Group. The inform­a­tion is only of a general nature, is non-binding, and is provided exclus­ively for inform­a­tional purposes.

Product specific­a­tions must in any case be agreed in writing or can be provided by the respective company of the Brügge­mann Group in writing, in a separate docu­ment marked as binding, if the separate docu­ment expressly refers to a specific order process. Every buyer or user of a Brügge­mann product is respons­ible for testing the chem­ical and phys­ical prop­er­ties of the respective Brügge­mann product and its suit­ab­ility for the intended use or purpose. The companies of the Brügge­mann Group shall under no circum­stances be liable to buyers or users of Brügge­mann products for any damage resulting from the use or applic­a­tion of the Brügge­mann products described herein, the inform­a­tion provided by a company of the Brügge­mann Group, irre­spective of its fault, or from the infringe­ment of patents, trade­marks or other indus­trial prop­erty rights. This limit­a­tion of liab­ility in partic­ular includes direct and indirect damages of any kind (including general, special or acci­dental damages as well as consequen­tial damages, lump sums, contrac­tual penal­ties or punitive damages and loss of profit, loss of use or addi­tional costs in connec­tion with the use of the product) as well as material damage and personal injury to buyers or users of Brügge­mann products.

The buyers and users of Brügge­mann products are oblig­ated to procure the relevant safety inform­a­tion and to review it before use or deploy­ment of Brügge­mann products.

All provi­sions of the General Condi­tions of Sale of the indi­vidual companies of the Brügge­mann Group, in partic­ular the provi­sions on limit­a­tions of liab­ility, apply to the sales of Brügge­mann products by the respective company of the Brügge­mann Group.
